About these terms
These terms apply to every valet company, venue and operator that uses the Elite Valet dashboard, apps and services (the "company"), and to its managers. A manager who agrees to these terms accepts them for themselves and for each company they manage, and confirms that they are allowed to do so.
Elite Valet's role
Elite Valet provides software to the company. Elite Valet does not provide valet, parking, driving or key-keeping services, is not the company's employer, agent or partner, and never takes possession of customers' cars, keys or items, or of the company's cash. Card payments are processed by a payment provider; Elite Valet collects card money for a company only where a separate written arrangement says so.
The company is solely responsible
To the fullest extent permitted by applicable law, the company is solely responsible for: the valet service it provides; customers' cars, keys and items from hand-over until return; parking, driving and safety; damage, theft, loss, fines and towing; delays and waiting times; hiring, checking, training, licensing, supervising and paying its staff, and their conduct and treatment of customers; prices, fees, cash and card payments, receipts, invoices, taxes, refunds, chargebacks and disputes; the loyalty and birthday offers it chooses to give; customer complaints and claims; and everything its staff add, such as photos, chat messages, notes and replies.
Insurance
The company must hold, at its own cost, all insurance required by law and suitable for its activity, for example liability insurance that covers cars, keys and their contents while in its care, motor insurance and employer's insurance. The company shows proof of insurance to Elite Valet when asked.
Following the law
The company follows every law that applies to it, including business and valet licences, employment, traffic and parking rules, consumer protection, tax and invoicing, anti-money-laundering and data protection. Settings in the dashboard (prices, receipts, retention, photos, permissions) are the company's own choices. Elite Valet does not give legal, tax or accounting advice.
Data handled for the company
For the visits it handles, the company decides why and how customer and staff data is used, and Elite Valet processes that data for the company to provide the software, as the privacy policy explains. The company must have a lawful reason to collect the data, inform its customers and staff, give access only to authorised staff, and tell Elite Valet promptly about any security problem. Elite Valet keeps the data secure, uses it only to provide, protect and improve the service and to meet legal duties, and helps the company answer data requests.
Accounts and permissions
The company decides who has access and with which permissions, and is responsible for every action taken with its staff accounts. Remove access as soon as someone leaves.
Operator agreements and linked places
When a venue and a valet operator approve a schedule in the dashboard, each company stays responsible for its own part, and the operator serving on site is responsible for the cars, keys and service during its shifts. Linked companies share only the data needed to provide the service.
Fees
Fees for using Elite Valet, if any, are those set in the company's Elite Valet billing plan.
Indemnity
To the fullest extent permitted by applicable law, the company will defend, indemnify and hold harmless Elite Valet, its owners, staff and suppliers against any claim, loss, damage, fine, cost or expense (including reasonable legal fees) arising from the valet service, customers' cars, keys or items, the company's staff, payments or refunds, a breach of these terms or of the law, or data the company or its staff enter.
Limitation of liability
To the fullest extent permitted by applicable law: the software is provided "as is" and "as available"; Elite Valet is not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill; Elite Valet is not liable for losses caused by outages, internet loss, late notifications or third-party services; and Elite Valet's total liability is limited to the fees the company paid to Elite Valet in the three months before the claim. Liability that the law does not allow to be limited is not limited.
Suspension and ending
Elite Valet may suspend access to protect customers, staff, the service or to follow the law, or when these terms are broken. The company may stop using the service at any time. Records that must be kept are kept as the privacy policy explains.
Events outside our control, changes and severability
Elite Valet is not responsible for delays or failures caused by events outside its reasonable control. Elite Valet may change these terms; managers are asked to accept a new version before they continue. If part of these terms cannot be enforced, the rest still applies.
Governing law and contact
These terms are governed by the laws that apply where the company provides its valet service, to the fullest extent permitted by applicable law. Questions: use the Contact us page on the Elite Valet website.
